Quadrupes pecus: cría y domesticación bajo el prisma de la interpretación de la lex Aquilia

Partiendo de una cuestión de taxonomía jurídica, el presente estudio se propone examinar cómo la natura —categoría mediante la cual los juristas romanos confieren relevancia a las cualidades vitales de los animalia distintos del ser humano— y el proceso de domesticación contribuyen a estructurar la disciplina del daño aquiliano, condicionando su aplicación al reconocimiento, en el animal muerto o lesionado, de determinadas características. En particular, la investigación se centra en la locución quadrupes vel pecus, poniendo en valor los problemas interpretativos que plantea este sintagma a la luz de un célebre pasaje de Gayo (D. 9.2.2.2). El testimonio del jurista reviste, en efecto, un especial interés, ya que el análisis del dato léxico, al delimitar el ámbito semántico del término pecus, revela cómo dicha expresión técnica traduce la atribución de un valor económico específico a la organización productiva del ganado. Esta perspectiva permite arrojar luz sobre el papel desempeñado por la domesticación de ciertas especies animales en la configuración de la economía productiva romana.
