This paper examines the Roman legal principle of postliminium rei, with a particular focus on the legal status of animals and their role as war booty. Drawing from D. 49.15.2.1-2 and other classical legal sources, the study analyses how animals captured during military conflict were treated under postliminium and explores the conditions that determined their restitution. The paper addresses the classification of animals as res mancipi or res nec mancipi, their patrimonial function, and the legal bond with their dominus. Ultimately, the paper establishes a connection between Roman law and contemporary legislation, highlighting the transition from the objectification of animals to their recognition as sentient beings.
