International legal best practices on custodial management of trafficked live wild animals

Abstract

Crafting legal best practices, no matter the subject area, is in all cases a lengthy process generally taking years or decades and requiring a wide variety of contributions. In the field of confiscations of wild animals from trafficking, this publication aims to make an initial contribution and lay the foundation for building best legal practices, given that it is an area of incipient legal development at a global level, and practically non-existent in many jurisdictions. The proposal is being launched to the community of practice after a year of work based on an extensive literature analysis and the legislative review of pioneering countries in the field, including Australia, Canada, China, the European Union, France, India, Norway, the Philippines, and the United States. The paper proposes a total of 26 legal best practices for the regulation of confiscations, which are expected to be expanded in the future. Best practices are organized thematically to cover aspects of governance, animal care, transportation, disposition, investigation, and criminal prosecution.

Author Biographies

Español, Legal Atlas, LLC

Maria Pascual is a development professional with educational degrees in Economics, Environmental Law, and Food & Nutrition and 25 years of international experience. Back in 2011, she co-founded Legal Atlas to leverage the power of technology in generating legal intelligence to improve those laws currently hindering environmental, social and economic development opportunities. Since then, it has been involved in 30+ research projects compiling, analyzing, and comparing legal approaches used by countries in subjects such as EIA, wildlife trade, money-laundering, anti-corruption, marine fisheries, forest, etc.  As a result, has participated in developing legal agendas to guide countries in legal reform for particular topics. She has been involved in the development of the Legal Atlas online platform and all the taxonomies used to generate dynamic legal intelligence from static legal documents.

Jim R. Wingard , Legal Atlas, LLC

Jim Wingard is Co-Founder and the Legal Director of Legal Atlas, an award winning, online platform for global legal intelligence. Mr. Wingard brings 26 years of experience to the venture as an international legal development specialist, and has participated in 50+ projects including numerous in-country assignments in Africa, Asia, Central Asia and Latin America. The Legal Atlas® platform uses the power of information technologies to support advanced legal assessments and advocacy. As its Legal Director, he oversees the development and application of all compilation and assessment methods, acts as the supervising analyst for all topical research, as well as conducts comparative and best practice assessments. His other experience includes drafting and negotiation of multi-lateral agreements, advice on compliance with international treaties, analysis, development, and publication of legal best practice principles, and the development of national legislation. He has traveled extensively in this capacity and worked in many countries including Rwanda, Afghanistan, Bhutan, China, Kazakhstan, Kyrgyzstan, Mongolia, Pakistan, Uzbekistan, Tajikistan, Turkmenistan, East Timor, and Indonesia. Jim Wingard has a strong facility for language including fluency in five languages: French, German, Spanish, Mongolian, and English.

Loïs Lelanchon, International Fund for Animal Welfare (IFAW)

Loïs Lelanchon is Head of Program for Wildlife Rescue at the International Fund for Animal Welfare (IFAW). He leads the organization’s Live Animals Seized in Trade (LAST) initiatives globally to help law enforcement officials implement the procedures and best practices needed to properly care for animals confiscated from wildlife trafficking. In this regard, he supervises and advises on projects to combat wildlife crime notably in Asia, Africa and South America. As a lawyer specialized in environmental and animal law, Loïs is an advocate for legal and policy improvements to ensure synergies between global wildlife conservation and animal welfare policies and field initiatives.
