Animal. Una aproximación biojurídica

La noción jurídica de animal debe partir de una aproximación biológica, que permita abarcar con claridad y sencillez la complejidad que el término animal encierra. Otras denominaciones que no son jurídicas como “animal no-humano”, “los demás animales” o “los otros animales”, son aproximaciones bienpensantes, con un trasfondo ético, influidas por un deseo de evidenciar respeto por los animales, que deberían evitarse en el ámbito jurídico en beneficio de la exactitud que los textos normativos requieren. Este artículo se propone analizar qué es un animal para el Derecho, partiendo de una consideración de la naturaleza biológica del mismo, para proponer una noción biojurídica del animal que pueda incorporarse a los textos normativos.
